SC issues notice to Haryana Police on lady advocate's plea alleging sexual assault by Gurugram police officials

The Supreme Court issued notices to the Haryana government and the state's police on a plea filed by a female advocate alleging rape and sexual assault allegedly committed by police officials.

New Delhi [India], June 20 (HBTV): The Supreme Court issued notices to the Haryana government, the State Police, and the Station House Officer (SHO) of Sector 50 Police Station, Gurugram, on a plea filed by an advocate alleging rape, sexual assault, and other serious offences allegedly committed by police officials.

A bench comprising Justices Prashant Kumar Mishra and Augustine George Masih directed the concerned authorities to file their responses within four weeks.

The advocate's counsel urged the Court to transfer the investigation outside Gurugram, citing concerns over impartiality. The counsel also requested the constitution of a Special Investigation Team (SIT) to ensure a fair and independent probe.

Additionally, a plea was made to restrain any coercive action against the petitioner. However, the bench declined this request at this stage and limited its order to issuing notices for replies from the State authorities.

According to the complainant, on May 21, she visited the Sector 51 women’s police station in Gurugram along with her client, who was to join an investigation in a case filed by his wife.

She alleged that while returning to Delhi after the investigation, the complainant’s wife intercepted their car, hurled abuses, and threw a stone at the car window.

Following this, the complainant and her client dialed 112 and went to the Sector 50 Police Station to file a counter-complaint. While the client was drafting the complaint, a woman constable allegedly tried to prevent him from doing so.

The advocate claimed that when she objected to the constable’s interference, she was forcibly taken to the SHO's room. She further alleged that when she raised her concerns with the SHO, he threatened her.

‘You are standing in Gurgaon, not in Delhi. 365 lawyers come here daily. I will teach you advocacy. You don’t know our power, I will do whatever I want,’ the SHO said, according to the FIR filed with the Delhi Police. The SHO then reportedly ordered the woman constable to leave the room.

A case was subsequently registered against the advocate herself. She was detained until early morning and later released on police bail. Attempts to contact the SHO on his official number and the police station’s landline were unsuccessful.

On May 22, a zero FIR was registered at the Sabzi Mandi Police Station in Delhi. However, according to the advocate, the case was transferred back to the same Gurugram police station where the accused officers are posted.

Consequently, she approached the Supreme Court seeking to have the case transferred outside Gurugram and for an SIT-led investigation.

In response, the Court issued notices to the State authorities, directing them to submit their replies to the complainant’s petition.
